Aggravated Assault

Under Arizona law, an individual can commit two types of assault with varying levels of severity; these include misdemeanor assault and felony aggravated assault. When you touch another person with harmful intentions or knowingly place that person in a dangerous situation, you may be charged with assault. If there is a deadly weapon involved in the assault, the charge may be upgraded to felony aggravated assault.
When Assault Becomes a Felony
There are certain circumstances that must have taken place in order for misdemeanor assault and battery charges to become felony aggravated assault. If you are facing aggravated assault and battery charges, your situation may have included any of the following:
- the victim was caused serious physical injury
- a deadly weapon of dangerous instrument was used
- the act included sexual abuse and assault

- the victim’s home was unlawfully entered to commit the assault
- the victim was under 15 and you were over 18 years of age
- a valid order of protection was violated
- the victim was a police officer, firefighter, EMT, paramedic, teacher, school employee, or licensed health professional engaged in his/her official duties
- a police officer’s firearm or other weapon was taken
- the assault was committed by a prisoner against an employee or a jail or place of law enforcement
