Criminal Homicide Charges
Homicide is the killing of one human being by another. In the United States legal system, there are varying degrees of homicide charges. The state of Arizona divides homicide crimes into the following 4 categories:
- Negligent Homicide: Is a class-4 felony and a crime that occurs when a person allows or causes the death of another through negligent criminal activity (i.e., DUI). It is less severe than 1st and 2nd degree murder with a punishment comparable to manslaughter.
- Manslaughter: A class-2 felony; it is considered to be less severe than murder under the United States constitution. A homicide is considered to be manslaughter if the killer did not have the intention to kill or create a deadly situation. Manslaughter is usually a crime of passion that occurs in the heat of a situation.
- Murder in the 2nd Degree: A class-1 felony punishable by up to 25 years in prison with no parole. It is a homicidal act in which one person intentionally kills another without premeditation.
- Murder in the 1st Degree: The most severe degree of all felonies. Those convicted of 1st Degree murder may be sentenced to life in prison or capital punishment. It occurs when a person kills another by an intentional, premeditated act.
