According A.R.S. § 13-1304 as stipulated by the Arizona Department of Public Safety, kidnapping occurs when a person knowingly restrains another person with the intent to:
- Hold the victim for ransom, as a shield or hostage; or
- Hold the victim for involuntary servitude; or
- Inflict death, physical injury or a sexual offense on the victim, or to otherwise aid in the commission of a felony; or
- Place the victim or a third person in reasonable apprehension of imminent physical injury to the victim or the third person; or
- Interfere with the performance of a governmental or political function; or
- Seize or exercise control over any airplane, train, bus, ship or other vehicle.

Being charged with a kidnapping offense is serious. There are various levels to this serious crime; they are:
- Class-2 Felony: If the victim is released without physical injury and before the defendant is arrested or commits another offense, the kidnapping may be considered a class-2 felony. Class-2 felonies are punishable by no more than 10 years and no less than 4 years in prison.
- Class-3 Felony: Kidnapping is a class-3 felony if the victim is released without any physical injury as a result of an agreement made with the state. Class-3 felonies are punishable by no more than 7 years and no less than 2.5 years in prison.
- Class-4 Felony: If the victim is released without physical injury before the defendant is arrested and before they commit any further offenses, the kidnapping may be considered a class-4 felony. Class-4 felonies are punishable by no more than 3.75 and no less than 1.5 years in prison.
